Acceptable Use Policy (AUP)

2. Background and Definitions

2.1 The Ukrainian Research and Academic Network URAN (URAN Network) which provides satisfaction of communication and information needs of the education, research and culture communities in Ukraine, is the collection of all networking services and facilities for routing, commutation, information receiving and transmission through electromagnetic systems using IP protocol.

2.2 The Association of Users of Ukrainian Research and Academic Network URAN (URAN Association) is responsible for the development and operating of the URAN Network.

2.3 This Policy applies directly to any organization (a “User Organization”) which is authorized to use the URAN Network and has signed an appropriate contract with the URAN Association. The User Organizations will be responsible to ensure that their end-users use the URAN Network services in an acceptable manner and in accordance with the current legislation.

2.4 It is therefore recommended that each User Organization establishes its own Acceptable Use Policy (AUP) within the context of the services it provides to its end-users, and in a form that is compatible with the conditions expressed in this Policy. The User Organization’s AUP may refer to, or include, this document.

2.5 Types of traffic that should be distinguished:

2.5.1 commercial traffic is IP-traffic between organizations that are neither research, nor educational in nature;

2.5.2 commodity traffic is IP-traffic between a research or education institutions and a non-research or education organization;

2.5.3 research traffic is IP-traffic between research or education organizations;

2.5.4 high performance research traffic is IP-traffic between a small subset of research and education institutions that requires high performance networks and services such as Quality of Service (QoS) for effective delivery.

3. URAN Users

3.1 Any institution, establishment or enterprise with main activity in science, education or culture field could be a User Organization of the URAN Network.

3.2 To be connected to the URAN Network the User Organization should provide a short reference about the Organization’s activity, where in addition to other info should be described whether the Organization is:

3.2.1 scientific institution, as it is described in Law of Ukraine “About scientific, scientific and technical activity” of December 13, 1991 No 1977-XII, Article I, i.e. legal entity of any pattern of ownership for which the main activity is science or science and technical activity and this activity comes to 70% of general annual volume of the executed works;

3.2.2 educational institution, as it is described in Paragraph 1 of the Regulations about licensing of educational institutions (which was approved by Ministry of Ukraine of February 12, 1996 No 200), i.e. legal entity of any departmental subordination and pattern of ownership, which leads activity concerned with educational service providing, preparing specialists of different qualification levels, and obtained appropriate licence;

3.2.3 institution, enterprise or organization of culture, as it is described in Article I of Basis of legislation of Ukraine about culture of February 14, 1992 No 2117- XII, i.e. such institution, enterprise or organization which engaged in creation, dissemination and popularization of works of literature and art; conservation and use of culture values; aesthetic education; special education, recreation and leisure arrangement.

3.3 Following institutions have preferences for connection to the URAN:

3.3.1 scientific institutions, which have state attestation and were entered in the State Register of scientific institutions, which has government support, particularly science institutions of National Academy of Science and branch Academies of Science (Ukrainian Academy of Agrarian Science, Academy of Medical Science of Ukraine, Academy of Pedagogical Science of Ukraine, Academy of Law Science of Ukraine, Academy of Arts of Ukraine);

3.3.2 institutes of higher education of III-IV accreditation levels;

3.3.3 education and science Administrations of local governing institutions.

3.4 A group of scientific, educational or cultural organizations technically connected by corporative (local) network could be treated as single consolidated user.

4. Acceptable Use

4.1 A User Organization may use URAN Network services for the purposes of information exchange and scientific research with other User Organizations, and with organizations interconnected to networks, which are made accessible based on agreements signed by the URAN Association.

4.2 The URAN Network accepts research traffic, high performance research traffic and commodity traffic. Commercial traffic is not allowed, except in cases of demonstration service limited in time (no more than one week monthly).

4.3 The URAN Association may allocate IP address space from its address block to User Organizations.

4.4 A User Organization could have independent from provider IP-address block or autonomous system which could be connected to the URAN providing that

4.4.1 the User Organization engages not to assign parts of this space to commercial organizations (to those which are not scientific, educational or cultural as it is described in Paragraph 3.2);

4.4.2 this autonomous system is not used for transit traffic transmission.

5. Unacceptable Use

The URAN Network may not be used for any of the following:

5.1 The creation or transmission (other than for properly supervised and lawful research purposes) of any offensive, agressive, pornographic or defamatory texts, images, data or other material, or any other information which are inadmissible according to the Ukrainian legislation.

5.2 The creation or transmission of material which is designed or likely to cause annoyance, inconvenience or needless anxiety for the users.

5.3 The transmission of materials that infringes the Copyright Law.

5.4 The transmission of unsolicited commercial or advertising materials either to other User Organizations, or to organizations connected to other networks.

5.5 Deliberate unauthorized access to facilities or services accessible via the URAN Network.

5.6. Deliberate activities with any of the following characteristics:

5.6.1 wasting of staff effort or networking resources, including processing time on end systems accessible via the URAN Network and the effort of staff involved in the support of those systems;

5.6.2 corrupting or destroying other users' data;

5.6.3 violating the privacy of other users;

5.6.4 disrupting the work of other users;

5.6.5 using the URAN Network in a way that denies service to other users (for example, deliberate or reckless overloading of access links or of switching equipment);

5.6.6 continuing to use an item of networking software or hardware after the URAN Network system administrators have requested that use to be ceased because it was causing disruption to the correct functioning of the URAN Network;

5.6.7 other misuse of the URAN Network or networked resources, such as the introduction of viruses.
